Jurisdictional scope

Fisionow operates in Costa Rica, Mexico, and the United States (initially Florida). These terms must comply with: HIPAA where US Protected Health Information is processed, Costa Rica Ley 8968 / Reglamento N° 37554-JP, applicable Mexican federal data-protection law, and Florida FIPA (breach notification) plus the Florida Digital Bill of Rights where in scope. Section drafting must reflect each regime explicitly.

  1. Acceptance of terms

    Placeholder. Describe how users accept these terms (account creation, continued use) and how minors / non-eligible users are excluded.

  2. Description of service

    Placeholder. Define Fisionow's service surface for physiotherapists and patients — scheduling, treatment plans, payments, public booking — and clarify that Fisionow is a software platform, not a provider of healthcare.

  3. Eligibility and accounts

    Placeholder. Age requirements, professional credentialing for physiotherapists, and account-security responsibilities (credentials, MFA, device trust).

  4. Acceptable use

    Placeholder. Prohibited conduct, anti-fraud, prohibition on using Fisionow for non-licensed clinical activity, and platform-integrity rules.

  5. Subscriptions, billing, and refunds

    Placeholder. Subscription tiers, billing cadence, currencies (CRC, MXN, USD), tax handling, refund policy, dispute resolution with the payment processor.

  6. Patient data and HIPAA Business Associate posture

    Placeholder. If Fisionow processes US Protected Health Information, the company acts as a HIPAA Business Associate to physiotherapists who are Covered Entities. A Business Associate Agreement (BAA) is required prior to use in scope. Minimum- necessary use, breach-notification SLAs, audit-log retention.

  7. Intellectual property

    Placeholder. Ownership of platform IP, license granted to users, user-generated content (treatment plans, exercise libraries) and the limited license users grant to Fisionow to operate the service.

  8. Disclaimers and limitation of liability

    Placeholder. Service-as-is disclaimer, exclusion of clinical-judgment liability, cap on damages — to be drafted within the limits each jurisdiction allows.

  9. Termination

    Placeholder. Voluntary termination, suspension for cause, data-export window post- termination, and retention obligations under HIPAA / Ley 8968 that survive termination.

  10. Governing law and venue

    Placeholder. Per-jurisdiction governing law, dispute resolution forum, and any arbitration clauses (where enforceable).

  11. Changes to these terms

    Placeholder. Notice mechanism for material changes and how continued use signals acceptance.
